The annual fee is 350 EUR. This applies to companies based outside Germany (VAT-reversed, i.e., net = gross), as the GDPR Representative service is provided in Germany. Even though we have a Swiss branch office, the GDPR Representative services are logically rendered in the EU, as this is precisely the purpose. Our main office in Germany must therefore be indicated accordingly.
Invoices in CHF, US Dollars, or EUR?
We will issue your invoice in EURO. When making transfers (if you do not have a EURO account), please ensure that exactly the amount stated on the invoice is credited to our account. Therefore, for international transfers, please designate your company as the payer of bank charges.
And for those who prefer it completely straightforward, you can simply pay the invoice via PayPal (here you can use your own PayPal account, bank account, or credit card). The direct link to the law firm’s PayPal account is: https://paypal.me/matutis?locale.x=de_DE
Scope of Service for GDPR Representative Appointment and Costs for Mail Handling
We will then serve as your data protection contact for third parties in the EU. In this capacity, we naturally receive emails and postal mail addressed to us.
We will, of course, sift through these between spam, advertising, and relevant mail. Pure informational mail, advertising, spam, etc., will be destroyed. Genuine mail that cannot be 100% certainly identified as advertising will be scanned and forwarded to you. The corresponding scanning and forwarding via email is already covered by the annual flat fee.
For each letter that we are to forward to you in original, we charge a processing fee of 2 EUR for forwarding, plus the applicable postage costs. However, we assume that you will not have unnecessary mail sent to this address, but rather that only relevant communication with authorities or inquiries from data subjects will be received and forwarded to you. These postal charges will always be billed at the end of a month, or, if the sums are small, annually at the latest.
Should un-scannable mail be received (e.g., small parcels, merchandise shipments, etc.), our processing fee is 5 EUR plus the applicable postage costs for forwarding. However, we do not expect any such un-scannable mail items to be received here.
If you have no interest in parcels or small packages, or if sending scanned PDFs of correspondence is sufficient for you, the shipment will be destroyed in compliance with data protection regulations, as is appropriate for a law firm. For this, we do not charge any separate fees.
What if We Are Expected Not Only to Receive Mail, but Also to Respond?
If, on the other hand, we are to respond to authorities or data subjects on your behalf, we will charge for our services according to a separate agreement, which must then be made on a case-by-case basis. Since you generally remain legally responsible for data protection as a company, the response can always be handled directly by you or your data protection officer, so that the interposition of my law firm is not strictly necessary.
Further details can be found in our contract for the appointment as a GDPR Representative.
